The Federal Trade Commission (FTC) has finalized an order banning General Motors and OnStar from sharing drivers’ precise geolocation and driving data with consumer reporting agencies. The action follows reports that GM collected data through its Smart Driver program and sold it to data brokers, which was then used by insurance companies to potentially raise rates. GM discontinued the Smart Driver program in April 2024.
Under the new order, GM must obtain explicit consent from consumers before collecting their data and establish a system for them to view, delete, or disable data collection. GM must also be transparent about its data practices. The company stated it has already complied with these mandates and overhauled its privacy policies. Exceptions to the ban allow sharing anonymized data for internal research and emergency services.
