OpenAI and Microsoft have challenged this valuation, arguing that Wazzan’s methodology is flawed. They contend he arbitrarily reallocated Microsoft’s stake to the nonprofit, effectively double-counting value to inflate Musk’s damages estimate. Microsoft asserts that the calculations lack a valid economic or contractual rationale and misrepresent the financial structure of the organization.
